EVENT TERMS AND CONDITIONS

(Virtual & Physical)

1. INTRODUCTION

The physical event is organised and managed by My Drive Around the Globe
References to “us” means My Drive Around the Globe and references to “we” and “our” shall be construed accordingly. Reference to “you” means the entity or individual completing a booking request and references to “your” shall be construed accordingly.
All applications to register for the event are made subject to these Terms and Conditions (which shall apply to the exclusion of any terms imposed by you).
Sponsors acknowledge and accept that we have the right to publicly announce our business relationship with you which shall include but not be limited to announcements on social media. Such announcements shall not bring into disrepute or otherwise adverse to the Sponsors business.

 

2. BOOKINGS

All applications to register for the event are subject to availability and your making full payment.
Confirmation (or rejection) of your booking will be sent to you via email from our ticketing partner within 24 hours of your booking, all non-charity bookings are subject to Clause 9.
Delegate passes issued for use at the Event are valid for named attendees only and can be transferred at our discretion upon written request. You may be asked for a photographic ID during the Event. If you are unable to provide identification that matches your delegate pass you may be asked to leave the event.
My Drive Around the Globe and venue management reserve the right to refuse admission or to eject delegates in circumstances deemed reasonable (for example, due to concerns regarding health and safety, security, or environmental concerns), and may on occasion conduct security searches to ensure the safety of delegates. Delegates may also be refused entry or ejected from the venue on account of exhibiting anti-social behaviour or declining to be searched. No refunds will be offered to delegates who are refused entry or who are ejected in these circumstances.
Neither My Drive Around the Globe nor the venue operator will be responsible for loss, damage, death or injury incurred, unless (i) the relevant party has breached its legal obligations and (ii) such loss or damage is a direct or reasonable foreseeable result of the breach.
Compensation for loss or damage to personal property brought to the venue that occurs within the exclusions above will be limited to the cost of repair or replacement, taking into consideration wear and tear.

 

3. CHANGES TO THE EVENT AND CANCELLATIONS

It may be necessary for reasons beyond our reasonable control to alter the advertised content, advertised speakers, date, timing and/or location of the event. We reserve the right to do this at any time. Where we alter the time and/or location of the Event, we will provide you with notice of the same and will offer you the choice of either a credit for a future event of your choice (up to the value of sums paid by you in respect of the event) or the opportunity to attend the event as varied.
If you are unable to attend the event, we welcome substitute delegates attending in your place at no extra cost provided that we have at least 5 days prior notice of the name of your proposed substitute and have received payment in full. No refunds will be given in respect of any cancellations or non-attendance. Any refunds given will be at our discretion. If you have a refund query please reach out to us at events@charitydigital.org.uk
We shall not be liable to you for travel, accommodation or other costs and expenses incurred (including wasted costs and expenses) if we are required to cancel or relocate the Event.
We shall not be liable to you for any costs incurred as a result of an event outside our control (including, without limitation, acts of God, floods, lightning, storm, fire, explosion, war, military operations, acts of terrorism or threats of any such acts, any strike action, lock-outs or other industrial action and a pandemic, epidemic or other widespread illness).

 

4. CONTENT

All rights in all presentations, documentation and materials published or otherwise made available as part of the Event (including but not limited to any documentation packs or audio or audio-visual recording of the event) (“Content”) are owned exclusively by David M J Finch or are included with the permission of the owner of the rights. You shall not:
a. modify any of the content for commercial or any other purposes; or
b. use Content in any way that might infringe third-party rights or that may bring us or any of our affiliates into disrepute.
c.You are welcome to share event content on social media platforms as long as “© My Drive Around the Globe 2025” is cited as the reference (the reference must be as shown) and a suitable link to mydrivearoundtheglobe.com is included in the shared content.

Suggestions or advice contained in the Content should not be relied upon in place of professional or other advice.

To the extent that any Content is made available by us online, we reserve the right to suspend or remove access to such Content at any time.
The copyright of all material rests with the Speaker and David M J Finch (My Drive Around the Globe) and My Drive Around the Globe or David M J Finch will not be held responsible for any infringements as a result of plagiarism, libel, slander or misuse of material.
Unless explicitly stated to the contrary, materials presented at My Drive Around the Globe events may not be reproduced, copied, or in any way incorporated into or stored on any website, electronic retrieval system, publication or in any other form, that exists now or may exist in the future.

 

5. LIABILITY

My Drive Around the Globe or David M J Finch shall not be liable to you for (i) any loss of profit, loss of or damage to data, loss of anticipated savings or interest, loss of or damage to reputation or goodwill or; (ii) any indirect, special or consequential damages, loss, costs, claims or expenses of any kind.
You agree to indemnify My Drive Around the Globe or David M J Finch, our staff, volunteers and our affiliates and to hold us harmless to the fullest extent permitted by law, against all loss, costs, claims or expenses of any kind arising from any act or omission by you (including your delegates) during or otherwise in relation to a Event.
Nothing in these Terms and Conditions shall limit or exclude either party’s liability for:
a. death or personal injury caused by that party’s negligence, or the negligence of that party’s employees, agents or subcontractors;
b. fraud or fraudulent misrepresentation; or
c. any other liability which cannot be limited or excluded by applicable law.

6. GENERAL

These Terms and Conditions (together with any documents referred to herein or required to be entered into pursuant to these Terms and Conditions) contain the entire agreement and understanding between us and supersede all prior agreements, understandings or arrangements (both oral and written) relating to the subject matter of these Terms and Conditions and any such document.
You acknowledge that in registering a delegate place you have not relied on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person other than as expressly set out in these Terms and Conditions.
These Terms and Conditions shall not create, nor shall they be construed as creating, any partnership or agency relationship between us.
You accept that communication with us may be electronic. We may contact you by e-mail or provide you with information by posting notices on our website. You agree to this electronic means of communication and you acknowledge that all such communications that we provide to you electronically comply with any legal or contractual requirement that such communication be made in writing.
You are not permitted to re-sell, transfer, assign or otherwise dispose of any of your rights or obligations arising under these Terms and Conditions.
These Terms and Conditions and the rights and obligations of both parties shall be governed by, and construed in accordance with, the laws of England and Wales and both parties irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute which arises hereunder.
Any breach shall be deemed a material breach of these Terms and Conditions.

Film and Video Rights:

The sole and exclusive right to create, manufacture, advertise, promote, and/or distribute on a sale or rental basis on its own or through licensees, or any other visual or optical recording devices (including, but not limited to, CD-I, CD ROM, DVD) and all other optically or other digitally read devices now known or hereafter discovered, containing any and all language versions of the Picture, Film or Video for use by consumers and the right to exploit the Picture by means of “On-Demand-Services” (collectively, “Videograms”). “Video-On-Demand” shall mean the transmission of a selected Picture, Film, or Video from a central library or source via a television, cable system, satellite, laptop, Computer pad, home computer, or any related electronic system now known or hereafter discovered, where reception of said Picture, Film or Video at a viewing time selected by the viewer is available only upon payment of a charge, which charge may be in addition to any charge for reception of the central library or source and/or programming channel are the property of David M J Finch in perpetuity.
